Terms & Conditions
These terms and conditions form the sale agreement between yourself and The Vintage Cake Stand.
The terms and conditions of hire apply to a customer who orders online, in person, by email or via the telephone.
Please make sure you have read and understood these terms. If you do not agree to them, please do not make any payment.

1. BOOKING, PRICES & PAYMENTS
Quotes given apply only to the specific product and date quoted for. Quotes are only valid for 28 days. After this please let us know if you want to proceed before making payment, as the price may have changed.
Your booking date is not secured until your deposit is paid and you have reviewed and completed the booking and agreement form sent to you via email. A deposit of 50% is required when placing your order. This confirms the legally binding contract. This Contract may be modified with agreement from both parties before the commencement of the Event. Where mutually agreed, this Contract may be amended, reissued and any further payment made before the Event commences. All booking forms must be returned via email containing ALL relevant information to secure booking at the same time as paying the holding deposit. No booking is secured without all forms and payments complete.
Payment should be made by bank transfer. As payment reference please give the date of your event, and if the bank account name is different to the name you have booked under, please add the booking name to the reference as well so your payment can be identified.
Cheques are not accepted. Charge-backs will be reported as fraud.
Your deposit secures your date, and this means that we are now turning down other work for your date. Your deposit is non-refundable if you cancel within 21 days of the order being fulfilled, to cover our loss of work for that date.
Our minimum order for china hire is for 4 people.
The Vintage Cake Stand will let you know when further advance payments are due - these will cover any early preparation work and our up front expenses for your order.
Your final balance is due 14 days before your event date.
Your order will not be completed if full payment is not made, but we will send a reminder 7 days before the balance payment is due.
If payments are not made on time your order may be cancelled. We reserve the right to keep monies paid to cover our reasonable losses. Remaining monies, after our losses have been covered will be refunded.
If you require delivery, you will be informed when quoting, whether delivery is included in the price or not; and if not included, how much that charge will be.
2. CHANGES TO YOUR ORDER
Please be certain of the products you want before placing the order, as any changes may be chargeable if they cost us more in time or materials.
If you need to make any changes please do so as soon as possible.
We order specific materials and turn down other work for your date, so you may lose monies paid if the changes are significant and cost us time and/or money.
Changes cannot be made 7 days before the order is due, as work will already have begun.
Some designs, products, flavours, dietary requirements, delivery areas may not be supplied by The Vintage Cake Stand and so your order may need to be cancelled if these changes are essential. In this case, we reserve the right to keep monies paid to cover our reasonable losses.
If you want to change to a significantly smaller order and it is too late for us to book other work for that date, we reserve the right to keep monies paid to cover our reasonable losses.
If your order is kept the same but postponed to a later date, please give as much notice as possible so we can book work in for the original date. If your new date is not available, this will be classed as a cancellation and you may lose up-front payments to cover our reasonable losses for work already done or materials already bought that can't be used elsewhere.
If you need to change the time of delivery please advise as soon as possible. We are a home-based business but this does not mean we are available for deliveries at all times due to family and life commitments.
If you aren’t available when we have arranged to deliver your products, no refund can be given because we have fulfilled our obligations under the sales contract.
It is not our wish, or in our interest, to leave you out of pocket, so in all situations please give us as much notice as possible to save losses on both sides.
3. CANCELLATIONS
If you need to cancel your order, please give as much notice as possible so we can halt work on your order and book other work for your date. Cancellation must be made by email to info@thevintagecakestand.com
We reserve the right to keep monies paid to cover our reasonable losses.
If the event is cancelled by the customer between 7 and 14 days prior to the event date then 50% of the hire charge will be payable. If the event is cancelled by the customer between 0 and 6 days prior to the event date then 80% of the hire charge will be payable. If the event is cancelled by the customer prior to the event date then the damage deposit will be refunded in full.
If we need to cancel your order due to situations out of our control, we will refund all monies paid.
If we choose to cancel your order due to breach of contract by you - for example, payments not made, unreasonable behaviour, or changes that we cannot accommodate - we reserve the right to keep monies paid to cover our reasonable losses.
If you need to cancel when your order is already fully made, we have fulfilled our side of the sales contract and so no refund or replacement can be given.
4. COMPLAINTS, REFUNDS & RETURNS

MELTING & COLLAPSE:
You will be supplied with care advice for your food product. Our products are fragile and are made from ingredients that melt at high temperatures. Some finishes are damaged by humidity.
Our production process ensures our products are supplied properly assembled, at the correct storage temperature and in suitable packaging.
Therefore complaints will not be accepted regarding melting after supply.
Complaints will not be accepted regarding collapse due to impact or tipping (for example travelling on a car seat or not driving carefully), while in your care or the care of someone on your behalf.
Please take special note of this if you are travelling a long way with the product, or having an event in hot weather, outdoors or in a marquee. Feel free to ask for our advice regarding hot weather or outdoor events.
b) HANDLING
Please handle your food products with care and always keep them level. Carry them flat by placing both hands underneath the box - holding the sides may cause damage to the products.
In warm and hot weather, please ensure your you have fridge space to store products once they have been delivered and remove from the fridge 1 - 2 hours before serving, depending on the weather conditions.
Products may contain non-edible items such as dowels and dried or fresh flowers, therefore please ensure these are removed before eating. If your cake has a topper please note that card, glues and glitter card are flammable materials and care must be taken to not allow it to get in contact with any naked flames.
Please note - The Vintage Cake stand accepts no liability for any damage to an order after it has been delivered. Please follow the advice and guidance given regarding handling.
c) DAMAGE OR CONTAMINATION CAUSED BY OTHERS:
If your product is delivered to a venue, staff will be clearly advised not to move the products especially in the case of tiered cakes or complicated arrangements. Photos will be taken of the products in situ to prove condition and position. If your products are damaged, or any items are stolen, this is not our responsibility after we leave the venue.
Please ask the venue and any venue dressers to have food tables ready so the products will not need to be handled after setup.
If anyone other than The Vintage Cake Stand adds decor to the food products, complaints regarding damage or contamination will not be considered.
Please be aware many fresh flowers are toxic to varying degrees and should not be in contact with food.
Any non-food-safe flowers supplied by your florist will not be used.
Toppers bought from unreputable suppliers may not be food safe and may pose safety concerns.
If you are adding candles or sparklers please follow the manufacturer's safety instructions and please keep naked flames away from decor elements.

FLAVOUR, TEXTURE & FOOD SAFETY ISSUES:
Complaints about flavour or texture must be notified as soon as possible.
Your product will come as fresh as possible and with an 'eat by' date label - please return your product before this ends so we can investigate the complaint.
Please store your items as advised by us - chilled cake and cupcakes will seem dry due to the fats solidifying. If non-chilled products are accidentally kept in the fridge, please bring them to room temperature before eating. Storing our non-chilled products in the fridge, especially during hot/humid weather or kitchen conditions, will cause condensation that may spoil the quality. If you have been supplied an item that needs to be kept chilled, this is for food safety reasons.
If we ask for a return, as much of the product as possible should be returned with cut edges covered in cling film or foil. If the product has been eaten or discarded, or not stored properly, we cannot investigate your complaint properly so no refund can be given.
The Vintage Cake Stand is qualified and complies with all food safety regulations including food allergy regulations.
Cakes may contain non-edible elements and we will make you aware of these during the consultation process. Please remove these before serving and do not leave the cake unattended around children.
Please supervise your more unruly guests during the candle blowing to make sure no one does a 'cake smash'as many cakes contain essential food-safe support dowels that can cause injury if misused.
e) CAKE NOT AS DESCRIBED:
To avoid issues with your food products please double check your order confirmation before making any payment. If the product does not match the order confirmation, please let us know as soon as possible, then we will do our best to rectify the situation. Statutory consumer rights apply always.
If your florist has supplied non-food-safe flowers for the cake, they will not be used because liability stands with us if we add them to the cake.
f) REFUNDS:
Refunds will be issued as per consumer law within 14 days of us agreeing to refund, by the same payment method unless otherwise agreed. Refunds will only be offered to the buyer.
Bespoke floral arrangements are strictly non-returnable as they are made exclusively for you.
g) RESPECT:
Please allow us 48 hours to investigate and respond to complaints.
We politely request that you give us a chance to rectify any complaint before leaving a review or posting on social media.
Please also refrain from offensive or threatening behaviour - we want to rectify such situations amicably. Threats and intimidation will be reported to the police. Unfair social media posts or reviews will be reported to the platform.
5. DIETARY REQUIREMENTS/PREFERENCES
Please advise dietary requirements or preferences before you make any payment, as not all can be catered for.
If you advise us after your order is placed this counts as a change to your order - please see the above section 'CHANGES TO YOUR ORDER'.
a) COELIAC, FOOD ALLERGIES & INTOLERANCES:
The Vintage Cake Stand is qualified and registered as a food business with the local authority, and adheres strictly to food safety legislation, but runs from what is a normal family kitchen outside of production hours. For this reason there is a risk of trace contamination of the 14 most common food allergens.
Please discuss any allergies or dietary requirements with us when ordering. Our products are not suitable for those with allergies as they may have come into contact with: cereals containing gluten, eggs, lupin, milk, nuts, peanuts, sesame seeds, soya beans, sulphur dioxide & sulphites and tree nuts (almonds, hazelnuts, walnuts, brazil nuts, cashews, pecans, pistachios, macadamia nuts).
Your products will be labelled with allergen advice so please keep this information and pass it on to anyone handling or consuming the cake.
As a sweet producer our products are not suitable for diabetics.
Some of our products contain food colourings that may affect attention and hyperactivity in children. Please pass this information to anyone handling or consuming the cake.
b) VEGAN, VEGETARIAN, PLANT BASED, HALAL, KOSHER ETC:
As strictness varies between individuals, if you require a product that conforms to your beliefs, please advise what you specifically need us to omit. We may not be able to supply such products depending on your requirements.
All products are produced in the same kitchen, so if you need your products made in a separate work area, or with separate utensils, then we regret that we cannot fulfil your order.
6. DELIVERY
You will be given a time window to expect delivery. This may not be changeable, especially at short notice.
All hired equipment and food products will normally be delivered on the morning of the day of the event, and collected the day after. Delivery and collection is free within a 3 mile radius of Morley LS27, thereafter a delivery charge of £5 will be applied. Due to the delicate nature of our products, we prefer to deliver and collect all hired items.
If the delivery venue or time changes, it may no longer be possible to deliver, or we may need to charge extra to cover our additional time and costs.
If it is not possible to make the changed delivery, and you cannot make other arrangements, your order may need to be cancelled. In this case we reserve the right to keep monies paid to cover our reasonable losses.
We will always check for local road delays and deliver ahead of time. If you are aware of roadworks please let us know as soon as possible so we can make arrangements.
VENUES:
Please give us contact details for the venue event organiser, plus venue dresser.
If the cake table is not sturdy enough, or is near a heat source we reserve the right to respectfully change the position of the cake. Please ask the venue and any venue dressers to have the cake table ready so it will not need to be handled after setup.
7. HIRE ITEMS

HIRE PERIOD - VINTAGE CHINA/TABLEWARE/GLASSWARE/CUTLERY/FLORAL ARRANGEMENTS
The prices listed are for one day’s hire, which covers 2 days, i.e. the morning of delivery and your event, and collection the following day.
£25 will be charged for delays of over 30 minutes to agreed collection times. Unless 1 hour’s prior notice is received. £50 will be charged for returns delayed by 1 hour or more from the agreed return time PLUS an additional £50 for every 24 hour period thereon. Contact phone numbers will be required on our booking form for returning appointment date/time including that of any third-party returning items. Any third-party returning stock please make them aware of all T&Cs above.
All items remain the property of The Vintage Cake Stand at all times.

LOSS OR DAMAGES
You are responsible for any breakages, damages, or loss of the hired items during the hire period. You will take all reasonable steps to protect the hired equipment from weather, theft, vandalism or improper use. You will return the hired equipment to The Vintage Cake Stand in the same condition as it was delivered. The hired items must not be moved from the delivery address/site unless agreed with The Vintage Cake Stand in writing at the time of booking.
The hire items should be always handled with care. Care should be taken when unpacking/repacking all china and glass ware. Vintage China and glassware should be unpacked onto a stable, level surface and care taken when in use. Floral arrangements should be kept away from naked flames, e.g. candles, and kept away from cigarette smoke.
Hire items will be in good vintage condition with no chips or cracks but due to the nature and age of the items patterns and gilt may show signs of wear. All hire items are STRICTLY HAND WASH ONLY. Please DO NOT wash any of the vintage china/glassware/cutlery due to its fragile nature, we prefer to do this ourselves and this service is included in the hire charge.
Please remove any food from plates and pour away any liquids from the teapots, milk jugs and teacups before repacking and we will do the rest. You must agree NOT to put any hire items in a dishwasher or microwave.
A damage deposit is required to cover any breakages, damages, or loss to the hired equipment during the hire period. Should the cost of damage or loss exceed the damage deposit, you agree to pay the balance.
The damage deposit will be paid when the final balance is due and will be refunded by bank transfer within 5 days of collection once the hired equipment has been washed and checked less any deduction for breakages damage or loss as per the scale of charges agreed at the time of booking.

A printed inventory of hired items will be signed by you and The Vintage Cake Stand at the point of delivery and collection.
All items to be returned in packaging supplied. All plastic and card packaging boxes must be returned or will incur a £10 charge per box. The Vintage Cake Stand do not hire candles and insist they are not used with any of our goods unless cleared with us beforehand. Any floral arrangements damaged with candle wax/smoke etc., will be chargeable per floral arrangement to replace.
ALL hire items MUST be packed suitably into the boxes provided and left in one pre-agreed collection point.
Insurance against damage or breakage, loss or theft is the responsibility of the customer. The Vintage Cake Stand will not be held responsible in the event of any injury or damage caused by the hired equipment during the hire period, however they are caused. The hire items are hired entirely at your own risk.
The Vintage Cake Stand's total liability to you under and/or arising in relation to any agreement shall not exceed the amount of the hire charge and charges for any services provided under that agreement.
7. PRIVACY & DATA PROTECTION
We will only collect personal data from you that is relevant to your order. This information will be kept securely by us, and only kept for a maximum of 6 months after supply.
We reserve the right to use images of your order for marketing - however, anything that clearly identifies the buyer or recipient will not be used without consent - for example edible photographs, 'Mr & Mrs Surname' toppers or tagging social media profiles.
